1. realisation of the contract
- The Stiftung niedersächsische Gedenkstätten, Stiftung des öffentlichen Rechts, 29223 Celle (hereinafter: "Foundation") agrees with the Purchaser that the following General Terms and Conditions of Payment and Delivery are recognised as binding. The following terms and conditions shall apply exclusively to these and all subsequent transactions with the Buyer. Any other terms and conditions of the Buyer shall not apply, unless they are individual agreements.
- In the case of an online order, our terms and conditions are deemed to have been accepted by the buyer when the order form is sent. Deviations by individual agreement must be made in writing by both parties.
- Unless otherwise agreed in writing, our offers are generally subject to change with regard to design, quantity, price, delivery time and delivery options.
- Delivery contracts are concluded either by our electronic order confirmations by e-mail after the buyer's order or by our delivery. All verbal agreements, in particular ancillary and supplementary agreements, including those concerning the execution of the order, require our separate written confirmation in order to be valid.
- The text of the contract is not stored by us and can no longer be retrieved after the order process has been completed. The buyer can print out the order confirmation during the order process. Furthermore, the buyer receives an order confirmation with all order data by e-mail if he has provided a correct e-mail address. This requires the technical availability of his e-mail inbox.
2. sales prices
- All prices are exclusive of shipping costs and inclusive of the currently applicable German VAT.
- For books subject to statutory fixed book prices, the fixed retail price at the time of delivery is decisive.
3. delivery and shipping costs
3.1 Shipping
- Orders from our foundation's online shop can be placed within Germany by direct debit, credit card and PayPal.
- The costs for postage and packaging are staggered as follows.
- Letter dispatch within Germany: € 2.90
- Parcel dispatch within Germany: € 5.00
- Letter dispatch within the EU: € 6.50
- Parcel dispatch within the EU: € 15.00
- Letter dispatch outside the EU: € 6.50
- Parcel dispatch outside the EU: € 35.00 - The general delivery time is 5 working days after receipt of the order. We check the order for stock availability and contact you by e-mail if items from the buyer's order cannot be delivered at short notice. A binding dispatch date can only result from the order confirmation or other individual communication. Compensation for damages in the event of late delivery is excluded unless gross negligence is involved. Delivery shall be made by Deutsche Post DHL.
3.2 Invoice
- The buyer receives the invoice together with the ordered goods.
4. terms of payment
- For orders within Germany, you can pay by direct debit, credit card or PayPal.
5 Retention of title and security for claims
- The goods shall remain the property of the Foundation until the agreed purchase price has been paid in full. In the event of resale by the purchaser, this shall be subject to retention of title, and the purchaser hereby assigns to the Foundation the claim against its customer arising from the resale up to the amount of the outstanding purchase price. The Purchaser undertakes to inform the Foundation immediately of any enforcement measures or any impairment of the right of ownership.
6. warranty
- During the warranty period of 2 years after delivery, we initially reserve the right to rectify the defect free of charge. If the rectification of defects fails, the buyer is entitled to the statutory warranty claims of cancellation (cancellation of the purchase) or reduction of the purchase price.
- This warranty is limited to the delivered goods, not to consequential damage or to damage or faults caused by improper handling or natural wear and tear.
7. liability
- The Foundation is not liable for manufacturer's warranties. We are not liable for defects caused by incorrect handling or external influences. The Foundation's liability for consequential damage caused by defects is excluded.
- For damages arising from product liability - personal injury and property damage - liability is limited to the extent that the Foundation assigns claims against the manufacturer or upstream dealers in the trade chain to the injured party.
8. data protection
- The Foundation stores personal data that is necessary for processing the buyer's order(s). These are initially the buyer's address details, telephone number and e-mail address. Furthermore, the respective order data (article, quantity, price, etc.) are assigned to the buyer's address data within the scope of the buyer's orders.
- We assure you that we will not pass this data on to third parties under any circumstances. Data is only passed on to Deutsche Post DHL, for example, for the processing of the buyer's orders as part of the necessary work. The Foundation does not make customer data available to third parties outside the Foundation.
9 Jurisdiction agreement
- The place of jurisdiction is Celle, Germany, insofar as it is a mutual commercial transaction.
- The law of the Federal Republic of Germany shall apply to all legal relationships between us and the Buyer, to the exclusion of the Vienna Convention on Contracts for the International Sale of Goods 1980 (CISG), even if the Buyer has its place of residence or registered office abroad.
10. severability clause
- Should one of these provisions be invalid, this shall not affect the validity of the remaining provisions. The invalid clause shall be replaced by a provision that comes as close as possible to it in economic terms.
